Civil Appeal in Pakistan: When and How a Civil Judgment May Be Challenged
An appeal is not simply a request to repeat the entire trial. The appellate court examines the judgment and record within the scope of the applicable appellate jurisdiction and legal grounds.
Start with the judgment
The first step is to obtain and carefully read the judgment and decree. Counsel should identify findings of fact, legal conclusions, evidence relied upon and the exact relief granted or refused.
Possible grounds
Depending on the case and appellate jurisdiction, grounds may concern misapplication of law, material procedural irregularity, improper appreciation of evidence or another recognized appellate error. Grounds should be tied to the record rather than broad dissatisfaction.
Limitation and urgency
Appeal deadlines are governed by the applicable law and can be critical. The Limitation Act, 1908 contains rules relating to limitation for appeals, subject to the relevant provision and circumstances. A potential appellant should seek advice promptly rather than waiting for the deadline.
Stay and interim relief
Filing an appeal does not automatically mean that every part of the decree is suspended. Where appropriate, a separate application for interim protection or stay may need to be considered under the applicable procedure.
