Specific Performance in Pakistan: Enforcing Certain Contractual Obligations
Specific performance is a civil remedy concerned with compelling performance of a contractual obligation in circumstances where the law permits such relief. It is not simply a substitute for every claim arising from a broken contract.
What is specific performance?
In an appropriate case, a court may order a party to perform a contractual obligation rather than limiting the claimant to a monetary remedy. The availability of relief depends on the nature of the contract and the requirements of the applicable law.
Proving the contract
The claimant should preserve the agreement, payment records, correspondence, receipts, notices and other evidence showing the contract and the parties' conduct. The terms of the agreement must be sufficiently clear for the court to determine what performance is sought.

A party seeking contractual relief should be prepared to demonstrate compliance with their own obligations and a legally sufficient basis for seeking enforcement. Conduct, delay and changes in circumstances can become important issues.
