Khula is a legal right available to a Muslim wife under the Family Laws of Pakistan whereby she may seek dissolution of marriage through the Family Court when continuation of the marital relationship becomes impossible. Khula proceedings are initiated when serious marital disputes, incompatibility, neglect, cruelty, lack of financial support, domestic conflicts or other circumstances make it difficult for the wife to continue living with her husband.
Unlike Talaq, which is pronounced by the husband, Khula is granted through a legal process conducted before the Family Court. The court examines the circumstances of the case, hears both parties and determines whether reconciliation is possible. Where reconciliation efforts fail and the court is satisfied that the marriage cannot continue peacefully, a decree for dissolution of marriage may be granted according to law.
